This Terms of Use Agreement (“Agreement”) sets forth the terms and conditions for your use of the mobile application (“Mobile Application” or “Service”) and all related products and services (” collectively, ‘Services’). This Agreement is legally binding between you (“User”, “you” or “your”) and this mobile application developer (“Operator”, “we”, “us” or “our”). By accessing and using the mobile application and services, you acknowledge that you have read, understood and agree to the terms of this Agreement. If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement. In this case, the terms “User”, “you” or “your” refer to such entity. If you do not have such authorization or do not agree to the terms of this Agreement, you may not accept this Agreement and may not access and use the Mobile Application and Mobile Services. You acknowledge that this Agreement is a contract between you and the Operator, even though it is electronic and not physically signed by you. It governs your use of the Mobile Application and the Services.
Links to other resources #
Although the mobile application and mobile services may be linked to other resources (such as websites, mobile applications, etc.), we do not imply, directly or indirectly, any approval, attribution, sponsorship, endorsement or affiliation with any linked resource unless specifically stated. Some of the links in the mobile application may be “affiliate links”. This means that if you click on the link and purchase an item, the operator will receive an affiliate commission. We are not responsible for reviewing or evaluating, and do not warrant the offerings of any company or individual or the content of their resources. We assume no responsibility or liability for the actions, products, services and content of other third parties. You should carefully review the legal notices and other terms of use of any resources you access through a link on the Mobile Application and the Services. You link to other external resources at your own risk.
Prohibited uses #
In addition to any other terms set forth in the Agreement, you are prohibited from using the Mobile Application and the Services or Content: (a) for any unlawful purpose; (b) solicit others to perform or participate in any unlawful activity; (c) violate any international, federal, provincial or state regulation, rule, law or local ordinance; (d) infringe or violate our intellectual property rights or the intellectual property rights of others; (e) harass, abuse, insult, harm, defame, libel, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) transmit false or misleading information; (g) upload or transmit viruses or other types of malicious code that are or may be used in a manner that adversely affects the functionality or operation of the Mobile Application and Services, Third Party Products and Services or the Internet; (h) spam, phish, pharm, pretext, spider, crawl, or scrape ; (i) for obscene or immoral purposes; or (j) to interfere with or circumvent the security features of the Mobile Application and Services, Third Party Products and Services or the Internet. We reserve the right to terminate your use of the Mobile Application and Services if you violate any of the Prohibited Uses.
Intellectual property rights #
“Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in or in respect of copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights in inventions, rights of use and all other Intellectual Property Rights, whether registered or unregistered, including all applications and rights which may be applied for and granted, priority claims, such rights and all similar or equivalent rights or forms of protection and other results of intellectual activity which exist or will exist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property of Operator or any third party, and all right, title and interest in and to such property (as between the parties) shall remain solely with Operator. All trademarks, service marks, graphics and logos used in connection with the Mobile Application and the Services are trademarks or registered trademarks of the Operator or its licensors. Other trademarks, service marks, graphics and logos used in connection with the mobile application and services may be trademarks of other third parties. Your use of the Mobile Application and Services does not grant you any right or license to reproduce or otherwise use any trademarks of the Operator or third parties.
Limitation of liability #
To the maximum extent permitted by applicable law, in no event shall the Operator, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for loss of profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity), but caused under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised of the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by law, the aggregate liability of the Operator and its affiliates, officers, employees, agents, suppliers and licensors in connection with the Services shall be limited to an amount greater of one euro or the amounts actually paid by you in cash to the Operator for the preceding one-month period prior to the first event or incident giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for losses or fails of its essential purpose. The information in the mobile applications is in no way a substitute for professional advice or treatment by trained and recognized physicians. The contents of LSN-Studios cannot and must not be used to independently diagnose or initiate treatment. All information within the mobile application is provided without guarantee of completeness, up-to-dateness or accuracy. Use of the mobile application is at your own risk.
Integration of external content (YouTube/videos) #
First aid instructions from third-party providers, such as organizations, hospitals or other institutions, are integrated into this app via YouTube. This content is independent of the app and is provided for information purposes only. The app and the operator have no connection to the providers of these videos and assume no responsibility for the accuracy, completeness or timeliness of the information contained therein.
Any liability or responsibility for the content of the external instructions lies exclusively with the respective providers. In an emergency, users should always contact the official authorities and not rely solely on the information provided via the app.
Integration of external content (images) #
This app uses third-party images from various sources, such as organizations, hospitals or other institutions. These images are for illustrative purposes and are provided by the respective authors. The app and the operator have no connection to the providers of these images and assume no responsibility for the accuracy, completeness or timeliness of the associated information.
Any liability or responsibility for the content of the external images lies exclusively with the respective providers. The operator of the app accepts no liability for possible copyright infringements resulting from the use of these images and recommends that users contact the respective authors directly if they have any questions.
No advertising through embedded content #
The videos and images from third-party providers included in this app, such as: B. organizations, hospitals or other facilities are intended solely for information about first aid. This content may contain advertising or references from the respective providers to their own websites, courses or services. The operator of the app does not adopt this advertising and does not pursue any commercial interests in connection with the integrated content.
Any advertising in the embedded videos or images comes exclusively from the respective authors and has no connection to the app or its operator. The app’s sole purpose is to make first aid information accessible without advertising or supporting it.
Compensation #
You agree to indemnify and hold the Operator and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising out of any allegations, claims, actions, disputes or demands made by any third party due to or arising out of your Content, your use of the Mobile Application and Mobile Services, or any willful misconduct by you against any of them.
Severability clause #
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they are not contrary to applicable law and shall be limited to the extent necessary to prevent this Agreement from becoming illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid or unenforceable, the parties intend that the remaining provisions or portions thereof shall constitute their agreement with respect to the Agreement. The subject matter of this Agreement and all remaining provisions or portions thereof shall remain in full force and effect.
Dispute resolution #
The formation, interpretation and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Germany, without regard to its conflict or choice of law provisions and, to the extent applicable, the laws of Germany. Exclusive jurisdiction and venue for any action relating to the subject matter of this Agreement shall be in the courts located in Germany, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a trial by jury in any proceeding arising out of or relating to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.
Changes and additions #
We reserve the right to change this Agreement or its terms relating to the Mobile Application and the Services at any time once an updated version of this Agreement is posted on the Mobile Application. If we do so, we will revise the updated date at the bottom of this page. Your continued use of the Mobile Application and the Services after any such changes will constitute your acceptance of such changes. The Policy was created using WebsitePolicies.
Acceptance of this condition #
You acknowledge that you have read this Agreement and agree to all of its terms and conditions. By accessing and using the Mobile Application and Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Mobile Application and Mobile Services.
Forwarding of data from the “SOS ID” and its functions #
You agree that your data from the “SOS ID” can be viewed by anyone by scanning the QR code on the lock screen, provided you have activated this option. Scanning the QR code opens a page at ennia.lsn-studios.de, which receives the parameters from the “SOS ID” and displays them accordingly – however, the data is not stored. A corresponding reference to the fact that this (your) data may not be passed on to third parties, with the exception of medical (specialist) personnel, is also displayed. You alone are responsible for ensuring that your data from the “SOS-ID” is up-to-date, correct and complete. LSN-Studios accepts no liability for the data to be displayed. Several ID cards can be stored. This is done as a photo, or in text form for the organ donor card. The data stored does not replace any medical, electronic or legal records. They are only for your personal documentation. You are responsible for the handling of the data by third parties.
